What is Probate?

Probate is the process of having the decedent's debt's paid and their property transferred to their heirs. When a person dies with a will, it is necessary to have the decedent's will administered and the will's terms enforced. A probate court judge will determine the validity of the will and ensure that the terms are carried out in accordance with the decedent’s wishes. If there is no will the probate court will administer the intestate estate of the decedent according to Texas law.

A probate attorney gets involved in the process to ensure that all matters relating to the will are handled properly. From filing an application to accept the will into probate, to working with the executor and creditors to ensure that debts and obligations are met, I take care of these issues so that you can concentrate on your family at this emotional time.

What if There is No Will?

If no valid will is in place, the estate is considered "intestate" and the judge must determine who is an heir and who is to be paid according to the probate code.
